Weather IncentivPay is operated by PMPS Inc. ("PMPS," "we," "us"). By accessing this site, submitting the activation form, or using the weather hedge or IncentivPay promotions (together, the "Service"), you agree to these Terms.

The Service is offered to business owners and authorized representatives who are at least 18 years old and located in the United States. You represent that you have authority to bind the business you register.

The weather revenue hedge is a revenue protection product for businesses. It is not insurance, a security, a wager, or a financial instrument offered to consumers. IncentivPay provides checkout promotions that drive repeat visits. Features, pricing, and availability may change, and we do not guarantee any particular revenue outcome.

Weather IncentivPay is free forever and requires no contract. There is no trial period, no subscription fee, no setup fee, and no cancellation fee. You may cancel at any time by replying STOP to our texts or emailing support@incentivpay.com.

Program description. By providing your mobile number and checking the consent box on our activation form, you agree to receive text messages from Weather IncentivPay (PMPS Inc.), including your setup link, activation status, hedge alerts, and account updates, sent using an automatic telephone dialing system.

• Consent is not a condition of purchase or of receiving any goods or services.
• Message frequency varies — typically 2 to 6 messages per month, plus transactional messages you request.
• Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Opt out any time by replying STOP to any message. You will receive one confirmation message and no further texts.
• Help — reply HELP to any message or email support@incentivpay.com.
• Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, and others.

Our SMS opt-in workflow and consent language are documented at /sms-opt-in-proof. Mobile opt-in data and consent are never sold or shared with third parties or affiliates for marketing purposes. See our Privacy Policy.

You agree not to:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• submit a phone number you are not authorized to enroll;
• send spam, phishing, or unsolicited commercial communications;
• infringe intellectual property or privacy rights;
• probe, scan, or attempt to breach the Service's security;
• scrape, resell, sublicense, or reverse-engineer the Service.

PMPS Inc. and its licensors own the Service, including all software, content, branding, and trademarks. You receive a limited, non-exclusive, revocable right to use the Service under these Terms.

The Service is provided "as is" and "as available." We do not warrant uninterrupted or error-free operation and disclaim all implied warranties to the fullest extent permitted by law. Nothing in the Service is financial, insurance, legal, or tax advice.

To the fullest extent permitted by law, PMPS Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our aggregate liability is capped at the greater of the amounts you paid us in the twelve months before the claim and USD 100.

You will indemnify PMPS Inc. against third-party claims arising from your use of the Service in violation of these Terms or applicable law, including claims arising from phone numbers you enroll without authorization.

We may suspend or terminate access for material breach, suspected fraud, security risk, or messaging abuse. Provisions that should survive termination will survive.

We may modify the Service or these Terms. Material changes are posted here with a revised "Last updated" date; continued use constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction.
